香川県警生活環境課は２４日、インターネット動画配信サイトを使って物乞い（こじき）行為をしたとして、軽犯罪法違反の疑いで高松市の無職の男性（２３）を書類送検した。物乞い行為をネットに流し、立件されるケースは珍しいという。
送検容疑は１月６日午後５時半～６時１０分ごろ、高松市浜ノ町のＪＲ高松駅周辺でパソコンを使ってサイトに接続し「僕お年玉もらってないと思う。高松駅周辺にいるのでお年玉をこのカップに入れてください」などと中継、不特定多数の閲覧者に金品を乞うた疑い。
軽犯罪法１条は、こじきをするか、こじきをさせた者を拘留か科料に処すると規定している。

ネット上での「物乞い」はやり方によっては軽犯罪法の「こじき」に該当する違法な行為で、「1日以上３０日未満の拘留」「１０００円以上１万円未満の科料」が科せられる可能性があるとのこと。ただし、軽犯罪法で罰せられる「こじき」とは「同情をかって金品を求める行為」を指すもの。単にAmazonの「ほしい物リスト」を公開するだけなら、同情をかう行為が存在しないため、「こじき」には該当しないとのことです。今回のケースは「僕、お年玉もらってない」などという発言が同情をかう行為ととられたのではないかとしています。
また、過去には「反復継続的に物乞いをした」ことで初めて「こじき」行為にあたるとしたように読める判例もあるそう。男性は過去にも同じような物乞い行為を行って香川県警から注意を受けていたとされており、注意を無視して物乞い行為を繰り返したことが、警察の書類送検という判断に影響を与えた可能性が高いと考えられるそうです。
