それはともかく、２０１２年の正月は内外の情勢から考えて、とても「おめでとう」とはいえない感じです。「いよいよ最悪の時代が始まります。命があったらまた会いましょう」。正しくはそう挨拶を交わすべきなのかもしれません。

誕生日の歌「ハッピー・バースデー・トゥー・ユー」は誰のもの？ かつて女優マリリン・モンローがケネディ大統領の前で歌い上げ、世界的に親しまれる歌の著作権をめぐり、米国で起こされた訴訟の判断が９月にも示される見通しだ。
訴訟は、１２０年以上前にさかのぼる歌の歴史を扱った映画を制作しようとしたニューヨークの会社が、著作権保持を主張する米音楽大手ワーナー・ミュージック・グループ傘下の出版社から１５００ドル（約１８万円）の支払いを求められたことが発端。
映画制作会社は２０１３年、「著作権はみんなのもの」と支払い不要の確認などを求めて提訴。結審が迫る今年７月下旬に、著作権を明示せずにこの歌を収録した１９２２年発行の本を見つけ、証拠として提出した。「明示しなければ権利なし」との当時の法令に従い、著作権が放棄されたはずだと主張している。
一方、ワーナー側は１９３５年に著作権が登録され、２０３０年まで権利があると反論。米国で著作権の保護期間が段階的に延長されたことも論拠にしている。

１２０年前から歌われている誕生祝いの定番ソング「ハッピー・バースデー」の著作権を巡って争われていた裁判で、米連邦裁判所は２２日、音楽出版大手のワーナー・チャペル・ミュージックによる著作権の主張を退ける判決を言い渡した。
裁判によると、ハッピー・バースデーの歌は１８９３年までにミルドレッド・ヒル、パティ・ヒルの姉妹が制作。姉妹から著作権を託されたクレイトン・サミーの会社を９８年にワーナー・ミュージック・グループが買収した。以来、同社はこの歌に対する著作権を主張して、ワーナー・チャペル・ミュージックを通じて年間２００万ドルを超す著作権収入を得てきた。
これに対し、ハッピー・バースデーの歌を使用して１５００ドル（約１８万円）の違約金を請求されたグッドモーニング・トゥ・ユー・プロダクションがワーナーを提訴。ワーナー側が著作権を主張できるのは、この歌そのものではなく、ピアノを使った特定の編曲に限られると主張していた。
２２日の判決で、ジョージ・キング裁判官は原告側の主張を認め、「サミー社はハッピー・バースデーの歌詞についての権利は取得しなかった。従ってサミー社の権利を引き継いだ被告には、ハッピー・バースデーの歌詞に対する有効な著作権はない」と認定した。
今回の判決ではハリウッドの大手映画会社が最も恩恵を受けることになりそうだ。映画会社はこれまで、裁判で争いになることを避けるためにワーナー側に著作権料を支払っていた。

慶応大学やカリフォルニア大学などのグループは、アメリカの高齢者の医療データを使って、２０１４年までの４年間に４万７０００人余りの外科医が行った緊急手術と患者の死亡との関連を調べた結果をイギリスの医学雑誌に発表しました。
それによりますと、外科医の誕生日に行われた手術は２０６４件で、３０日以内に１４５人が死亡していた一方、誕生日以外の手術はおよそ９８万件あり、死亡したのはおよそ５万５０００人でした。
患者の年齢や持病などを踏まえて死亡率を解析したところ、外科医の誕生日に手術を受けた患者では６・９％で、それ以外の患者の５・６％と比べ、およそ１・２倍になっていたとしています。
